Kaplan Fox, one of four co-lead counsels representing the plaintiffs in the antitrust allegations leveled at several air carriers, has revealed that a US$99 million settlement has been made with EVA Airways, which brings the total aggregate settlements in the long-running legal action to more than $1 billion.
Litigation is still pending against four of the defendants: Air China, Air India, Air New Zealand and Atlas Air Worldwide Holdings. The defendants in the lawsuit against the air cargo carriers seek to recover damages allegedly caused by the fixing the price of global surcharges from 1999 to 2006. A total of 13 carriers were named in two lawsuits, one in the U.S. and another in Germany.
